1. Acceptance of Terms

By accessing or using EWC Classifier ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

EWC Classifier provides AI-powered waste classification services using Google Gemini AI to help identify European Waste Catalogue (EWC) codes for UK regulatory compliance purposes.

Our service provides guidance only. Classifications are not legal advice and should not be relied upon as the sole basis for regulatory compliance. You are responsible for verifying all classifications and ensuring compliance with applicable waste management regulations.

3. User Accounts

  • Accounts are created via Google OAuth authentication
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities under your account
  • One account per user; sharing accounts is prohibited
  • We reserve the right to refuse service or terminate accounts

4. Credit System & Payments

Free Tier

All users receive 3 free waste classifications upon signup.

Paid Credits

  • Payments processed securely via Stripe
  • Credits are deducted upon successful classification completion
  • Unused credits do not expire

Refund Policy

No refunds are provided for used classification credits. If a classification fails due to a technical error on our end, the credit will be automatically refunded to your account.

5. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purpose or to facilitate illegal waste disposal
  • Attempt to manipulate, abuse, or exploit the AI classification system
  • Share your account credentials with others
  • Use automated tools to scrape, harvest, or make bulk requests without permission
  • Violate any applicable local, national, or international laws
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Service Limitations & Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE".

  • AI classifications are guidance, not guarantees
  • We do not warrant 100% accuracy of classifications
  • Results are not a substitute for professional waste management advice
  • Not legal advice or regulatory compliance certification
  • You remain solely responsible for regulatory compliance
  • We do not guarantee uninterrupted or error-free service
  • We reserve the right to modify or discontinue features

7. Intellectual Property

  • Our Property: The EWC Classifier platform, including all software, designs, text and trademarks, is our exclusive property.
  • Your Data: You retain ownership of waste descriptions and images you submit.
  • License to Us: By submitting data, you grant us a license to process it for the purpose of providing classification services.
  • AI Results: Classification results are provided for your use but do not constitute transfer of intellectual property rights.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • We are not liable for incorrect, inaccurate, or incomplete waste classifications
  • We are not liable for any regulatory non-compliance, fines, or penalties resulting from use of our Service
  • Our maximum liability is limited to the amount you paid us in the past 12 months
  • We are not liable for indirect, incidental, consequential, punitive or special damages
  • Some jurisdictions do not allow limitation of liability; in such cases, our liability is limited to the maximum extent permitted by law

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your waste management or disposal practices

10. Account Termination

By You

You may delete your account at any time through account settings.

By Us

We reserve the right to suspend or terminate your account immediately if you violate these Terms or for any other reason at our sole discretion.

Effect of Termination

Upon termination, your data will be deleted according to our Privacy Policy retention schedule. Unused credits are forfeited upon termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EWC Classifier regarding use of the Service.
